On the 27th anniversary of the establishment of the national industrial property system of the Republic of Tajikistan (1993-2020)
Today, exactly 27 years have passed since the formation of the national industrial property system of the Republic of Tajikistan. On this day, on the basis of Decree of the Government of the Republic of Tajikistan dated May 28, 1993 No. 242, an authorized state body in the field of legal protection of industrial property objects (inventions, industrial designs, trademarks and service marks, topologies of integrated circuits, geographical indications) State institution “National Center for patent and Information ” of the Ministry of Economic Development and Trade of the Republic of Tajikistan was established on the basis of the Tajik Scientific Research Institute of Scientific and Technical Information.
During this period, the employees of the Institution in order to apply the priorities of the strategic goals of the Government of the Republic and the wise policies of the Founder of Peace and National Unity, the Leader of the Nation, the President of the Republic of Tajikistan, respected Emomali Rakhmon in the field of intellectual property, in particular, the protection of state interests in the field of industrial property, made every effort to integrate the national intellectual potential in the development of inventions, entrepreneurship and strengthening the country’s economy.
During this short period of time, the institution accomplished important tasks of coordination, state support, stimulation, public awareness and development of this sphere, and notable results were achieved.
During this period, the legislative framework of the Republic of Tajikistan in the field of industrial property was supplemented by six laws, “On Inventions”, “On Industrial Designs”, “On Trademarks and Service Marks”, “On the Topology of Integrated Circuits”, “On Geographical Indications”, “ On secret inventions. “
During this period, the Republic of Tajikistan joined 25 international agreements and treaties in the field of protection of industrial property, and 5 Memorandums of Understanding were concluded with the Patent Offices of some states in order to develop further cooperation.
For the further development of the national intellectual property system, on the basis of the Government Decree of June 3, 2014 No. 371, the National Strategy for the Development of Intellectual Property of the Republic of Tajikistan for 2014-2020 was adopted.
The first patent for an invention was registered with the Patent Office on June 10, 1994. The number of issued patents for the invention is 492 and small patents for the invention are 1090.
And the first patent for an industrial design was registered on December 28, 1994. The number of issued patents for an industrial design is 101. The indicator of the Republic of Tajikistan for the registration of industrial designs under the international system (The Hague Agreement) is 750.
For the entire period of activity of the Patent Office for the national registration system, 13978 trademarks received state registration.
Also, the Patent Office, based on the Protocol to the Madrid System for the International Registration of Trademarks, has registered 47,525 trademarks since 1996.
During this period, citizens of the republic received 27 Eurasian invention patents under the Eurasian Patent Convention.
The number of Eurasian patents valid in the Republic of Tajikistan to date is 6,243.
In 1996, the publication of the official bulletin of the Patent Office of the Republic of Tajikistan “Navidi Patenti” (in Russian and Tajik) and from 2001 the scientific and practical journal Industrial Property and the Market (since 2017 “Industrial Property) began.
Also in 1996, the Institute of Patent Attorneys of the Republic of Tajikistan was established. Currently, 21 patent attorneys of the Republic of Tajikistan conduct their activities on the basis of the License, the Regulation “On Patent Attorneys of the Republic of Tajikistan” and the “Rules for the Certification and Registration of Patent Attorneys”.
Since 1993, the Appeals Board has been operating in the structure of the Institution, which, after considering a number of disputes in the field of industrial property, makes appropriate decisions are made. The Appeals Board is a pre-trial court for the settlement of disputes.
In order to increase the level of knowledge and training of specialists in the field of industrial property objects, on the initiative of the Institution, in 2003 the Interuniversity Department “Protection of Industrial Property Objects” was established.
At the initiative of the Institution in 2014 in order to ensure accessibility and meet the needs of users in information in the field of innovation and facilities intellectual property, the first National Innovation Internet Portal of the Republic of Tajikistan was created – www.innovation.tj.
Over the entire period of the Institution’s activity, 2044 candidate and doctoral dissertations, 450 information resources, 1832 scientific manuscripts, 4800 research and developmental works, 4100 personal papers of scientists received state registration.
It should be noted that, with the support of the Government of the Republic of Tajikistan, the Ministry of Economic Development and Trade of the Republic of Tajikistan, the State Institution “National Center for Patent and Information ” in order to present the achievements of innovators and inventors, scientists and entrepreneurs, as well as to support and stimulate inventors, innovators in recent years held various events, in particular – the Regional Conference and the Exhibition of Inventors Achievements, the Forum of Inventors of the Republic of Tajikistan, the Republican Competition “Young Innovators and Inventors”, the Republican Competition “The Best Inventor of Tajikistan” and the Republican Competition “Brand of the Year” which gave impetus to the development of intellectual property.
During the activity of the institution 22 inventors of the Republic of Tajikistan were awarded the WIPO Gold Medal; 13 people were awarded the V.I. Blinnikov Gold Medal of the Eurasian Patent Organization (“For Contribution to Inventive and Patent Activities”) and 26 inventors of the republic were awarded the Medal of Honor of the Patent Office of the Republic of Tajikistan.
In the period from 2012-2020, at the international exhibition “Women Inventors of the World”, annually held in Seoul, South Korea, the Scientific and Research Center for Science and Technology were presented 44 inventions of 34 women inventors of the country, who were awarded 15 gold medals, of which 2 were WIPO gold medals, 3 gold medals of the Association of Inventors of China, Thailand and Germany, as well as 18 silver and 13 bronze medals.
The state institution “National Center for Patent and Information” of the Ministry of Economic Development and Trade of the Republic of Tajikistan, in order to implement the policy of the Government, plans to take concrete measures to further develop the national industrial property system, the mechanism for the implementation of intellectual capital, and the organization of the legal framework for commercialization of industrial property and innovation processes.
