From November 1, 2022, it will be possible to include 3D models of the claimed objects in the Eurasian patent application. Innovation concerns both inventions and industrial designs.
The decision to start accepting by the Eurasian Patent Office (EAPO) three-dimensional models of the claimed objects while filing applications for the grant of a Eurasian patent for inventions or industrial designs was unanimously taken during the 41st meeting of the Administrative Council of the Eurasian Patent Organization (EAPO) in September 2022.
It was adopted taking into account the experience of Rospatent (Patent Office of the Russian Federation), which had previously successfully implemented such an initiative, and the readiness of the Rospatent for active joint work on technical debugging of the internal information systems of the EAPO.
The innovation will greatly simplify the process of examination of submitted applications, especially in relation to industrial designs, will optimize the consideration of applications, reveal and demonstrate in more detail the features of the claimed object. For advice on how to submit an application with 3D models and technical requirements for additional materials, please call +7 495 411-6161 or email email@example.com.
Documents regulating the application process with the application of 3D models can be found in the “Documents” section. Updated versions of Part I “Inventions” and Part II “Industrial Designs” of the Patent Regulations, the Rules for Drafting, Filing and Considering Applications for the Grant of Eurasian Patents for Inventions, the Rules for Drafting and Filing an Application for the Grant of a Eurasian Patent for an Industrial Design have already been published.
— This innovation will greatly simplify the process of filing a Eurasian application and obtaining a Eurasian patent for applicants. They will have more opportunities to demonstrate the claimed objects, and this will simplify the process of examination and preparation of a decision for EAPO experts. This is especially important in relation to industrial designs, design, and appearance of products. Moreover, the demand for the issuance of a Eurasian patent for industrial designs, which is valid on the territory of seven EAPO member-states, has doubled over the year. Applications for the issuance of a software patent come from all over the world, most actively they are filed from the Russian Federation,” commented Grigory Ivliev, EAPO President.
