Government Decree No. 242 of May 28, 1993 established the National Patent Information Center of the Republic of Tajikistan on the basis of the Tajik Institute for Scientific, Technical Information and Technical and Economic Research, one of whose priority areas of activity is the protection of state interests in industrial property, and also the coordination of inventive activity in the country.
In January 1994, the Republic of Tajikistan became a member of the World Intellectual Property Organization. According to the Declaration of the Republic of Tajikistan concerning the most important international treaties in the field of industrial property, Tajikistan recognizes their validity on its territory, i.e. Citizens of the Republic can use the procedures and standards provided for by international agreements.
Specialists of the National Patent Information Center took part in the development of the Eurasian Patent Organization and the drafting of the Eurasian Patent Convention, to which the country joined under the Act of Accession signed by the President of the Republic of Tajikistan E. Rahmon on April 14, 1995
On July 18, 2001, the Republic of Tajikistan received the status of an observer country in the WTO, and the Government of the country has a firm intention in the coming years to become a full member of this organization. Government circles, in particular, the Ministry of Economic Development and Trade, clearly understand the role and place of the national system for the protection of intellectual property in the process of accepting the country into WTO members. In this regard, the development of the legislative framework relating to the legal protection of industrial property objects has been and remains one of the main tasks of the National Patent Information Center. For 18 years, the legislative activity of the Patent Office of the Republic of Tajikistan has been very effective.
In 2003, the Order of the Ministry of Education of the Republic of Tajikistan No. 48 dated January 27, 2003 at the NPICenter created the inter-university department “Protection of Industrial Property Objects”, and issued a license to AU No. 0045 dated February 27, 2003 for the right to conduct educational activities in the field of intellectual education. property.
Our specialists together with experts and deputies of the Majlisi Namoyandagon Majlisi Oli of the Republic of Tajikistan (Parliament) took part in the discussion of the industry draft laws developed by the NPICenter, preparing analytical and explanatory materials and, thereby, contributing to a detailed and faster review of projects. As a result, at present, 5 Laws of the Republic of Tajikistan in the field of industrial property have entered into force: the Law of the Republic of Tajikistan “On Inventions” (No. 17 of February 28, 2004), the Law of the Republic of Tajikistan “On Industrial Designs” (No. 16 of 28.02. 2004), Law of the Republic of Tajikistan “On the legal protection of topographies of integrated circuits” (No. 218 of December 22, 2006), Law of the Republic of Tajikistan “On Trademarks and Service Marks” (No. 234 of March 5, 2007), Law of the Republic of Tajikistan “On Geographical Indications “(No. 236 dated March 5, 2007). It is obvious that the development of these regulatory documents and their adoption in the prescribed manner will not only allow our country to join the WTO, but also meets national interests in the field of legal protection of industrial property objects, the safety of industrial sectors and contributes to the fulfillment of obligations arising from our state’s participation in international treaties in the field of intellectual property.
The year 2006 was also significant, on the basis of the Memorandum of Understanding between the Government of the Republic of Tajikistan and the Government of the Republic of India, the Tajik-Indian Information Technology Center was established and started to function at the NPICenter, which, along with its main purpose, training modern information technologies processes associated with the main areas of detail NPICenter.
The results of 18 years of activity indicate an increase in the number of applications for the issuance of protective documents. Since 1993, the NPICenter received 1397 applications for invention, incl. 973 patent applications and 424 for a small patent. For the grant of a patent for an industrial design was filed 138 applications. The number of applications submitted under the national procedure for the registration of trademarks and service marks reached 10,846 units, the international registration exceeded 37,146.
Thus, it can be said with confidence that a national system for the protection of industrial property objects has been established and is functioning in the country, at the same time there are still many complex tasks to be solved in order for the Republic of Tajikistan to take its rightful place in the global system of intellectual property protection.
The history of the development of the national patent information center
The formation of an independent state – the Republic of Tajikistan and the processes of transition of the economy to market relations – put on the agenda the issue of creating new government bodies, in particular, a body became necessary to implement a unified state policy in the field of protection of industrial property objects.
In this regard, the Government Decree No. 242 of May 28, 1993. On the basis of the former Tajik Scientific Research Institute of Scientific, Technical Information and Technical and Economic Research (Tajik NIIINTI), the National Patent Information Center of the Republic of Tajikistan was established, which is entrusted with one of the main functions – protecting state interests in the field of inventions, industrial designs, commodity marks and service marks and other industrial property objects within the republic and abroad, as well as coordination of inventive activity.

On the establishment of the National Patent Information Center of the Republic of Tajikistan
In order to protect industrial property objects and further develop the system of scientific and technical information in the territory of the Republic of Tajikistan, the Council of Ministers of the Republic of Tajikistan decides:
To agree with the proposal of the Ministry of Economy of the Republic of Tajikistan to create at the same time the Ministry of the National Patent Information Center of the Republic of Tajikistan on the basis of the institute of this Ministry being liquidated. To refer the newly created National Patent Information Center (NPICenter) for remuneration to the first category of research institutes.
Establish the following main activities of the National Patent Information Center:
– protection of state interests, in the field of inventions, industrial designs, trademarks and service marks inside and abroad, coordination of inventive work in the republic;
– carrying out research work on the automation of information retrieval processes;
– preparation of analytical and synthetic materials on the most important achievements of world science and technology;
– coordination and carrying out activities to promote the achievements of science and technology and best practices;
– acquisition of a single reference information and patent fund of the Republic of Tajikistan, taking into account the peculiarities of its development, reference information and library services for enterprises, organizations and institutions of the republic;
– publication in accordance with the established procedure of the official bulletin of industrial property and other scientific and technical materials;
– registration and registration of research and development activities completed in the Republic (research and development);
preparation and issuance in the prescribed manner at the request of ministries, departments, organizations copies of reports on research and development.
To approve the proposal of the Ministry of Economy of the Republic of Tajikistan on the transformation of the Republican Scientific and Technical Library into the State Patent and Technical Library with its inclusion into the NPICenter.
To impose upon the NPICenter the obligation to protect the rights of industrial property objects of the Republic of Tajikistan, both within the state and abroad.
Within a month, the Ministry of Economy of the Republic of Tajikistan should develop and approve the regulation on the NPICenter, the procedure for registering and recording research and development work. To intensify the work of this center so that it will also facilitate the entry of the Republic of Tajikistan into the World Intellectual Property Organization and other international treaties and agreements on the protection of industrial property.
